July 30, 2007: Debate on New York “Safe Games Act”

Some New York game companies and others in the industry have raised concern about a recent bill in front the State Assembly, titled the “New York Safe Games Act of 2007”. They argue that that the proposed law makes it a felony to sell certain games in New York state, and provides no standard for deciding what is acceptable for sale and what is not. They are concerned both about the constitutionality of this law and also about the effect the proposed law would have on video game development in New York State.

MasurLaw, a technology law firm, has drafted a letter to Governor Spitzer opposing this legislation. Read it here

While NYSIA has no position on this legislation we are encouraging public debate and those in the industry to express their opinions. Would you like to publicly comment on this legislation, pro or con? Please fill out the form below or view the current feedback.

A bill will not solve any problems. The true way to stop these kids from playing these games is to simply be a good parent. Even when Atari debuted, they had X-rated games too...and I was not allowed to play them or buy them because my parents said so. Video games are the biggest part of the entertainment field now, and this would kill so much work for so many people.

This new legislation goes against constitution. New Yorkers should have the right to choose the games they want to buy!!

  Maurice Barron - Systemsforge
Position: Con

People should be allowed to make their own decisions about the games they wish to purchase. If they think its dis-tasteful then they dont buy it but at least they have the option

  Byron
Position: Con

I am against the bill, however I have seen some pretty distasteful games out there. The only problem is that anyone can oppose a particular game for no reason, or for the wrong reasons and not everyone agrees on wha is wrong or right. It borders on unconstitutional.
